I just thought that Lelouch found a loophole in the Code system, by killing another Code person rather his own and then acquires Code Geass. Or maybe he does have to die first before it's activated.
Regeneration is not a real issue, V.V. could comeback in seconds have a knife to the forehead. C.C.'s regenerate took awhile in R1, but likewise in R2, she recovers quickly after direct shot to heart. Charles regenerated quickly, too. Lelouch never shows his wound and the obscene amount of blood suggests to me that he, too, has the Code.
Black hair, pale skin, and formal clothes is enough to tell me the carriage driver is Lelouch.
